Attorney: ‘If Races Were Reversed,’ Cops Would Be Fired for Being Unsure If FB Live Torture Is Hate Crime

Fox News host Megyn Kelly on Wednesday reacted to the shocking Facebook Live video showing a mentally disabled white man being tortured by a group of black perpetrators in Chicago as they screamed, “F*** Donald Trump, f*** white people!”

Kelly asked attorney David Wohl if there could be a hate crime charge filed in the case due to the racially charged language used in the video.

Wohl said the obvious crimes committed are kidnapping, torture, assault with a deadly weapon, false imprisonment and likely others. However, he also said he was surprised by law enforcement officials’ statement on whether a hate crime was committed.

“What I found a little bit disturbing is the cops in a press conference said they’re not quite sure if this was a hate crime, it’s being investigated,” Wohl said. “And that’s after viewing this video.”

He added, “Rest assured, if the races were reversed and they said that, they’d be fired the next day.”

While police expressed their disgust at the “sickening” act, they would not confirm whether the case would be prosecuted as a hate crime. A police official told reporters that the perpetrators’ racially charged remarks would “certainly be part of whether or not we determine this a hate crime or whether or not this is stupid ranting and raving,”

Wohl then predicted prosecutors will decline to include the “hate crime enhancement.” But he also argued Sen. Jeff Sessions, President-elect Donald Trump’s pick for attorney general, would take the case “Very seriously” and could open a federal civil rights investigation.

“They can’t allow political correctness to dictate the prosecution here,” the attorney said.

Fox News contributor Richard Fowler, who is black, agreed that the Facebook Live torture video appears to show a hate crime.

“I think this is a hate crime, I don’t care what race you are,” Fowler said. “Politics aside here, this video is disgusting and I think we as a nation really got to sit down…and have a conversation about how we really come together.”

Police have arrested four suspects and formal charges are expected to follow.
